Terms of service
What PathTend provides, what you control, and the limits of the service.
Agreement version 2026-10-13.2
About these terms
Effective October 13, 2026. PathTend is operated by Vpulance LLC, a Minnesota limited liability company. These terms apply to your use of PathTend. Paid subscriptions at launch are for businesses using the service in the United States. Contact getpathtend@gmail.com for account, service or billing questions.
Eligibility and agreement
You must be at least 18 and able to enter a binding agreement. If you act for a business, you must have authority to bind it. Your affirmative acceptance applies to the Terms and Acceptable use version presented to you; an account alone is not evidence of acceptance. The Privacy notice explains information handling separately. Optional analytics and marketing choices are not required to accept these terms.
Using PathTend
PathTend helps businesses review website availability and selected public customer paths, organize findings, review repair proposals and manage workspaces. RepeatFix organizes records you import or enter, calculates recorded costs, and compares changes using your supplied data; it does not establish causation, guarantee savings or independently verify your records. Use it only for websites, accounts and information you own or are authorized to access. Protect your sign-in details and give teammates only the access they need. Tell us if you believe your account has been compromised.
What checks can tell you
A passing check means the tested step responded as recorded at that time. It does not prove every visitor can complete a purchase, submit a form or book an appointment. Coverage and frequency depend on the selected plan, approved paths and enabled capabilities. Website restrictions, third-party outages and queued work can affect results. PathTend does not guarantee uninterrupted service, detection of every issue, increased sales or a particular business outcome.
Repairs and external services
Review the evidence, proposed change and permissions before approving a repair. Some proposals are instructions you must carry out yourself; others can make a supported change through a connected platform after approval. Keep appropriate backups. Campaign-readiness and lead-delivery requests require a separately agreed scope; submitting a request does not mean a test has been performed. Connected services have their own terms and availability.
Your content and permissions
You retain your rights in the content you provide, including your business records, imported incident data and improvement notes. You must have permission to share it and authorize the processing needed to provide the functions you request. Avoid passwords, payment-card details and unnecessary sensitive information in notes or support messages.
Our brand and intellectual property
PathTend is a brand of Vpulance LLC. The PathTend name, logo and original brand materials belong to Vpulance LLC. As between you and Vpulance LLC, we and our licensors retain all rights in the service software, original website content, interface designs and documentation, except for your content and materials owned by third parties. Opening an account or buying a subscription does not transfer ownership of our brand or software to you.
Permission to use the service
While your account and any required subscription are active, you may access the hosted service for your authorized business purposes, subject to your plan limits and these terms. This permission is limited, non-exclusive and non-transferable; authorized teammates use their own permitted workspace access. It does not grant permission to copy, distribute, sublicense or resell our software or original brand materials, or to use the PathTend name or logo in a way that suggests an affiliation or endorsement we have not approved. Obtain our written permission for other brand uses. These restrictions do not override rights granted by applicable law or by a separate license governing third-party materials.
Plans, renewal and cancellation
Creating an account does not create a paid subscription. Subscriptions renew automatically at the billing interval selected at checkout until canceled. Prices are in US dollars, with applicable tax added at checkout. Starter monthly is $9 for the first month, then $29 per month. Growth monthly is $29.99 for the first month, then $79 per month. These introductory discounts apply automatically to a workspace’s first subscription when billed monthly, once only. They do not apply to annual plans, other tiers, renewals or a new subscription after cancellation. Your checkout confirms eligibility, included limits and actual charges. Annual plans are charged for the full year. Cancel through Plans & billing → Manage subscription before renewal to stop the next charge. Access continues through the end of the current paid period, then paid features stop. Canceling does not delete your account or workspace records.
Refund policy
Payments are non-refundable, including partial periods, unused service and cancellation during a paid period. Cancellation stops the next renewal; it does not refund the current paid period. This policy does not limit refunds or other remedies required by applicable law. Contact getpathtend@gmail.com promptly about duplicate, unauthorized or incorrect charges so they can be investigated and corrected where appropriate.
Suspension and termination
The Acceptable use policy is part of these terms. We may restrict access reasonably necessary to address a material breach, unlawful use, security threat or overdue payment. Where practical and lawful, we will explain the reason and allow you to correct it; urgent threats can require immediate action. Contact support to challenge a restriction, arrange access to available records or resolve billing. A restriction is not permission for us to keep charging indefinitely for a service we have permanently ended. Termination does not erase accrued payment obligations, applicable remedies or records needed for lawful purposes. Ownership, confidentiality of non-public credentials, liability, dispute and enforcement provisions survive as applicable.
Service limits and warranties
To the extent permitted by law, the service is provided as is and as available, without implied warranties of merchantability, fitness for a particular purpose or non-infringement. Evaluate findings and proposed changes before relying on them, retain your own source records and backups, and use human judgment for important business decisions. PathTend is not insurance or legal, tax or financial advice. This section does not override an express written commitment we make or warranties and remedies that cannot lawfully be excluded.
Limits on liability
To the extent permitted by law, neither party is liable under this agreement for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or business opportunity. Our total liability arising from the service is limited to the greater of $100 or the subscription fees you paid us for the affected workspace during the 12 months before the event giving rise to the claim. These limits do not excuse fraud, intentional misconduct, gross negligence or liability and remedies that applicable law does not allow to be limited. They do not cancel payment obligations, the indemnity obligations described below or remedies available for infringement, impersonation or unauthorized access. Courts determine whether a limitation applies.
Third-party claims caused by misuse
To the extent permitted by law, you agree to defend and indemnify Vpulance LLC against third-party claims, reasonable defense costs and resulting liabilities caused by your unlawful submitted content, infringement of another party’s intellectual property, unauthorized access or material misuse of the service. This does not cover claims caused by our own wrongful conduct. We will give prompt notice, reasonable cooperation and an opportunity for you to control the defense with appropriate counsel. Neither party may settle such a claim in a way that admits the other’s wrongdoing or imposes an obligation on the other without written consent, which must not be unreasonably withheld.
Protecting our rights and reporting abuse
Unauthorized copying of protected materials, deceptive use of our brand, impersonation and unauthorized access may lead to suspension and legal action where justified. We may seek remedies available under the facts and applicable law, including damages or injunctive relief; a court decides whether a remedy is warranted. These terms do not create automatic penalties, prove ownership of third-party materials or prevent lawful criticism, competition or permitted use. Report suspected misuse or an intellectual-property concern to getpathtend@gmail.com with the relevant URLs, dates, a description of the material or conduct, your contact details and evidence of your rights or authority. Do not send passwords or unnecessary personal information. We review reports and may preserve relevant evidence and respond as legally appropriate; a report alone does not prove a violation.
Disputes and governing law
Contact getpathtend@gmail.com with the account or invoice reference, issue and requested resolution. We encourage an informal resolution, but this is not a mandatory waiting period or a waiver of urgent relief, small-claims access or non-waivable rights. Minnesota law governs, excluding conflict-of-law rules and subject to mandatory applicable law. Subject to those rights and a court’s jurisdiction, disputes under this agreement may be brought in a competent state or federal court in Minnesota. Nothing here automatically awards attorney fees, requires arbitration or waives a jury trial or class proceeding.
Changes, notices and remaining terms
We display the current version and effective date. Material changes will be communicated before they apply, with fresh acceptance requested when appropriate or legally required; they do not retroactively change a recorded agreement. Keep your account email current. If a provision is unenforceable, the remainder continues to the extent lawful. Not enforcing a provision once is not a waiver. These terms, Acceptable use, the selected checkout terms and any separately signed agreement form the service agreement; a separately signed agreement controls a direct conflict within its scope. Neither party may assign this agreement in a way that removes mandatory rights; we may transfer it with the service in a lawful business reorganization, merger or sale with required notice. Contact support for a copy of your accepted terms.
